Mednick HRRV lawyers secure summary dismissal of appeal HRRV lawyers secured the summary dismissal of an appeal of a defense verdict recently won at trial in a malpractice action in Bronx County. In Ralph Arce v. Saul Mednick, M.D., d/b/a Dr. Saul Mednick D.M.D., the plaintiff had brought an action for alleged misfabrication of a maxillary bridge. At trial in Bronx County, the Court rendered a defense verdict dismissing the plaintiff’s complaint and plaintiff promptly filed a notice of appeal. Noting that the notice of appeal was defective and that plaintiff had failed to comply with proper appellate procedure, HRRV lawyers fired back moving to dismiss the appeal. After submission and argument of the motion, the Appellate Term, First Department agreed with HRRV’s position and summarily dismissed plaintiff’s appeal. Needless to say, the defense verdict and dismissal of the complaint stood. The defendant was represented by Sean P. Dwyer. Prior results do not guarantee a similar outcome
