E.T., HRRV wins acquittal for teacher at felony assault trial Using forensic experts and vigorous cross examination, HRRV attorneys successfully saved a client’s liberty and career at trial in Nassau County. In People of the State of New York v. E.T., the defendant-client, a teacher for disabled students and attending graduate school, was indicted for multiple counts of Assault in the Second Degree in connection with a street altercation that left the complainant with a fractured skull and closed head trauma. At trial, the prosecution charged that the injury was caused by a dangerous instrument wielded by the defendant. Claiming to have an iron-clad case backed by multiple witnesses, and, refusing to offer any lesser charge or plea to resolve the matter, the prosecution sought the maximum jail sentence. Never intimidated by the prosecution’s stance, the trial team of HRRV attorneys staged a tenacious defense attacking the credibility of the prosecution witnesses on cross-examination and effectively turning the tables by demonstrating that the complainant and his girlfriend had staged the altercation and were, in fact, the aggressors who started the fight which forced the client to desperately defend himself. Not leaving any dust to settle, HRRV lawyers then called a forensic expert on the defense case who confirmed that the alleged head injury was not caused by an instrument but rather by the prosecution’s star witness accidently striking his head against the ground while wrestling with the defendant. After less than two hours of deliberations, the Nassau County jury acquitted the client of all charges and dismissed the indictment. The defendant was represented by Sean P. Dwyer.
