HRRV scores victory for dental practice at trial A plaintiff seeking damages for alleged malpractice was sent out of court with a dismissed complaint after trial with HRRV attorneys defending a dental practice in Queens County. In Marilyn Tolchin v. Hillcrest Dental Associates, P.C., the plaintiff had brought suit for damages allegedly sustained when the defendant negligently created a treatment plan for fabrication of a maxillary bridge and advanced periodontal disease. At trial, HRRV argued that the treatment plan was appropriate and that plaintiff’s periodontal condition was caused by her own failure to comply with the doctor’s instructions and lack of acceptable oral hygiene. Further cross examination revealed that the plaintiff had, in fact, refused to comply with the instructions of her treating dentist which compounded her condition. A verdict for the defendant was rendered and the complaint was dismissed. The defendant was represented by Sean P. Dwyer. Prior results do not guarantee a similar outcome
